Here’s what you can expect from Photo Chalk, and what we ask of you. We’ve kept it readable on purpose.

The service
Photo Chalk provides software for school photographers to capture, organize, and deliver portraits and to sell prints and digital products to families. Schools and districts use it to manage rosters, scheduling, and data-protection agreements. Families use it to view and order photos.
Eligibility
You must be able to form a binding contract to use Photo Chalk. Photographer and school accounts are for business and institutional use. Family accounts are for viewing and purchasing photos. We do not knowingly create accounts for children; student data is handled only on behalf of the school under a Data Processing Agreement.
Accounts & security
You are responsible for keeping your login credentials confidential and for activity under your account. Administrator accounts require multi-factor authentication. Tell us promptly if you suspect unauthorized access.
Acceptable use
Do not misuse the service: no unlawful activity, no attempts to access data belonging to another tenant, no reverse engineering, no uploading malicious code, and no use of children’s images for any purpose other than the school photography program. We may suspend accounts that put student data or the platform at risk.
Intellectual property
Photographers retain the rights to the photos they create. Schools and families retain rights to their own content. Photo Chalk retains all rights to the software, brand, and underlying technology. We grant you a limited, non-transferable right to use the service while your account is active.
Subprocessors
We rely on a small set of vetted third-party vendors to operate the service. The current list — what each one does and what data it can access — is published on our subprocessors page and incorporated into our school agreements.
Privacy & student data
Our handling of personal information, and our commitment never to run facial recognition on students, is described in our privacy policy. Student data is processed only under a signed Data Processing Agreement with the school or district that controls it.
Warranty disclaimer
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, Photo Chalk is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service. Nothing here limits liability that cannot be limited under applicable law.
Governing law
These terms are governed by the laws of the United States and the state in which Photo Chalk is organized, without regard to conflict-of-laws rules. The final governing-law and venue provisions are being finalized with counsel.
Changes to these terms
We may update these terms as the service evolves. Material changes will be posted here with an updated date, and where required we’ll notify account holders. Continued use after an update means you accept the revised terms.
